These terms govern your use of this website and, from section 6, the basis on which Tomohard ltd, trading as Tomohard, deals with an enquiry about a mortgage, remortgage, protection policy or equity release. Please read them with the important information and disclaimer, the Privacy Policy and the Complaints procedure.
By using the website you agree to sections 1 to 5 and 11 to 17. Asking us to advise on or arrange a product is a separate step. We will confirm the scope of that work, and any fee, before you are committed to it.
1. Information about us
Tomohard ltd, trading as Tomohard.
Email: info@tomohard.com
Where we give regulated mortgage or lifetime-mortgage advice, that activity is subject to the UK regulatory regime and is aimed at customers in the United Kingdom. Our regulatory status, including any Financial Conduct Authority firm reference number, is confirmed in the documents we give you before you decide to proceed. You can check a firm on the Financial Services Register.
2. The website
We make this website available so you can read about our services and ask us to contact you. We may change, suspend or withdraw any page without notice, including where we need to correct information or meet a legal duty. We do not guarantee that the site will always be available, error-free, or free of harmful code, although we take reasonable care to keep it so.
The site is intended for people in the United Kingdom. We do not offer products or services to residents of other countries through this website, and we make no representation that the content is appropriate outside the UK.
3. Eligibility
You must be 18 or over to send an enquiry. Mortgage and equity-release products are available only to people who meet the lender’s or provider’s criteria, which normally include being a UK resident and having a legal interest in a UK property, or being in the process of buying one. Meeting the criteria on a website does not mean a lender will offer you a product.
4. Enquiries and appointments
If you submit the form, you ask us to contact you by telephone, email or post about the financial requirement you describe. You agree that the name, email address and telephone number you provide are yours and are accurate.
An enquiry is not an application for credit, does not reserve a rate, and does not by itself create a client relationship for regulated advice. A rate mentioned in a conversation or on a page can be withdrawn or repriced by the lender before an application is offered.
5. Information on this website is general
Pages, examples and illustrations on this website are general information. They are not a personal recommendation, not tax advice, and not an offer of credit. A personal recommendation is given only after we have assessed your circumstances and confirmed the scope of our service. Please read the disclaimer before you rely on anything you read here.
Your home may be repossessed if you do not keep up repayments on a mortgage or any other debt secured on it. Think carefully before securing other debts against your home.
6. Our services
Depending on what you ask us to do, and on what we are able to arrange, our work can include:
- an initial conversation about a purchase mortgage or a remortgage;
- research and a recommendation for a regulated mortgage;
- advice on and arrangement of a lifetime mortgage; and
- a referral to an approved specialist for a home reversion scheme, which is a different type of equity release.
Equity release includes lifetime mortgages and home reversion schemes. We can advise on and arrange lifetime mortgages. We refer home reversion enquiries to an approved specialist. Releasing equity will reduce the value of your estate and can affect your eligibility for means-tested benefits and the tax position of you or your estate.
Before regulated advice starts, we will tell you whether the service is independent or restricted, which lenders or products we can consider, how we are paid, and whether a fee is payable. The scope described in that disclosure is the service you receive. We do not advise on every product in the market unless that disclosure says we do.
7. Advice, illustrations and lender decisions
Any recommendation is based on the information you give us. You agree to provide complete and accurate information and to tell us promptly if it changes. If you withhold relevant information, or it is inaccurate, a recommendation may be unsuitable and a lender may withdraw an offer.
A decision to lend, the rate, the fees and the conditions are made by the lender or provider, not by us. We cannot require a lender to accept you. An agreement to lend is formed only when the lender issues a binding offer and any conditions of that offer are met. Early repayment charges, overpayments limits and other restrictions are set out in the lender’s documents. You should read those documents before you proceed.
Figures shown in an illustration are examples based on the assumptions stated in it. They are not a promise of the amount you will pay.
8. Fees and commission
A fee may be payable for our work. The amount depends on your circumstances and on the work you ask us to do. Before you agree to go ahead we will tell you the fee, or how it is calculated, when it becomes payable, and whether it is refundable.
We may also receive commission from a lender, insurer or other provider if a product is arranged. We will tell you the amount we know, or a reasonable estimate, before you apply. Commission is a cost of the product and is not an extra hidden charge on top of a fee we have already explained, unless we say otherwise. You may ask us to waive a fee and be paid by commission, or the reverse, where the rules and the product allow it. We will explain the options that apply to you.
Lender, valuation, legal and other third-party costs are payable to those third parties on their terms. They are separate from our fee.
9. Your responsibilities
- Give us information that is true, complete and up to date.
- Tell us about changes to income, employment, health, the property, or credit commitments if we are in the course of advising you or an application is open.
- Read the lender’s illustration, offer and tariff before you commit.
- Keep up repayments. Failure to pay a mortgage or other secured debt can lead to repossession of your home.
- Keep your own copies of documents we send you, and tell us promptly if you think a document is wrong.
10. Acceptable use of the website
You agree that you will not:
- use the site for any unlawful purpose;
- attempt to gain unauthorised access to the site, our lead-handling system, or another user’s information;
- introduce malware, probe or scan the site, or impose an unreasonable load on it;
- copy or scrape the site in bulk without our written permission; or
- submit an enquiry using another person’s identity or contact details.
We may remove content, block an enquiry, or suspend access where we reasonably believe these terms have been broken.
11. Intellectual property
The text, design, graphics and layout of this website are owned by Tomohard ltd or used under licence. You may view and print pages for your own private use in connection with an enquiry. You may not copy them for commercial use, or remove any copyright or branding, without our written consent. Trade marks of lenders and other firms remain the property of those firms.
12. Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that the law does not allow us to exclude or limit. If you are a consumer, you also keep the rights implied by the Consumer Rights Act 2015, which cannot be excluded.
Subject to that, we are not liable for loss that was not foreseeable when you used the site, for loss of profit or business opportunity arising from use of the website, or for a failure caused by an event outside our reasonable control. We are not liable for the content of a third-party website that we link to, or for a lender’s decision to decline an application or to change a rate.
Where we have given regulated advice, your rights in respect of that advice, including the right to complain and, where you are eligible, to refer a complaint to the Financial Ombudsman Service, are not reduced by this section. See the Complaints page.
13. Other documents
The Privacy Policy, UK GDPR notice, Cookie Policy, disclaimer, accessibility statement and complaints procedure form part of the information we give you about this website. If a later client agreement or disclosure document conflicts with these website terms on a point about the advice or the fee, the later document prevails for that advice.
14. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring a claim in your local courts. Mandatory protections of your home country inside the UK still apply.
15. Changes
We may update these terms by posting a new version on this page. The date at the top will change. The version that applies to an enquiry is the version published when you submit it, together with any service disclosure we then give you. Changes do not alter a fee or a recommendation we have already confirmed in writing, except where the law requires it or you agree.
16. Contact
Questions about these terms can be sent using the contact details in section 1.
